Registering of Foreign Trade Mark in Nepal:

A trademark registered in any foreign country can be registered in Nepal in the name of the foreign firms and companies. Department of Industry is the appropriate authority to register the Trademark, design and patents. A Trademark, which is not registered in any foreign country, cannot be registered in Nepal in the name of a foreign firm and company.

Application for registering the Trademark should be submitted in the format prescribed by the Department of Industries. The copy of prescribed format may be sent on request. The application should be signed by the authorized representative of the company (applicant), it should be witnessed by at least two witnesses, should bear the corporate seal (rubber stamp will do) of the applicant company and should also be duly notarized by the Notary Public. The application should be printed in the company's (applicant) letterhead for each Trademark for each class to be registered.

Power of Attorney:

Power of Attorney in favor of Pioneer Law granting express authority to sign related application and/or appoint representative in the matter of registration of the said Trademark should be sent to us along with the other documents. There is no specified format of the Power of Attorney. Any commonly used format will do. Pioneer Law can provide the format commonly used in Nepal for this purpose on request. However, Notary Public should certify the Power of Attorney.

Representation Sheets:

Eight copies (sets) of the trademark to be registered with Department of Industries in Nepal should be submitted along with the application.

Foreign Registration Certificate:

Foreign Registration Certificate (i.e. the registration in any foreign country) certificate is a must to register any foreign trademark in Nepal. A notarized photocopy of the home registration certificate is compulsory. Notarized photocopy of the home registration certificate for each class for each trademark is essential. If the certificate has been issued in language other than English (for example in Chinese or French language) it should be accompanied by English translation certified by Notary Public.

The Time Required for Registration:

The process of registration in our country is slightly dilatory. Normally, it may take at least 10 to 90 days to issue the registration certificate after the application is submitted to the Department of Industries.
