Registering of Foreign Patent & Design in Nepal:

Pioneer Law Associates also renders Patent/Design registration service. The objective of this note is to provide related information to those who wish to avail our service in the matter of Patent/Design registration in Nepal.

Registration of Foreign Patent/Design:

A Patent/Design registered in any foreign country can be registered in Nepal in the name of person, firms and companies. Department of Industry is the appropriate authority to register the Trademark, design and patents.

Application Form:

Application for registering the Patent/Design should be submitted in the format prescribed by the Department of Industries. The copy of prescribed format will be sent on request. The application should be signed by the authorized representative of the firm/company (applicant), it should be witnessed by at least two witnesses, should bear the corporate seal (rubber stamp will do) of the applicant firm/company and should also be duly notarized by the Notary Public. The application should be printed in the firm's/company's (applicant) letterhead for each Patent/Design.

The Documents Required:

1. Patent:

The following documents are required to be submitted for the registration of patent along with the application:

1. Name, address, occupation of the person or the firm/company of inventor of the patent.
    
2. If the applicant is not the inventor of the patent, the document giving right to the applicant by the inventor.
    
3. The method of using or operating of making of such patent.
    
4. If such patent is based on any specific principal or formula, such principal or formula.
    
5. Application for the registration of Patent.
    
6. Foreign registration certificate.

2. Design:

The following documents are required to be submitted for the registration of Design along with the application:

1. Name, address, occupation of the person or the firm/company of the design.
    
2. If the applicant is not the designer of the design, the document giving right to the applicant by the designer.
    
3. Statement including map and design (drawings)
    
4. Four copies of the drawings
    
5. Application for the registration of a design.
    
6. Foreign registration certificate.

Time Required:

The process of registration in our country is slightly dilatory. It may take at least 3 months to 3 years to issue the registration certificate of Patent/Design after the application (with complete documents and fee) has been submitted to the Department of Industries.

If foreign registration certificate has been submitted along with the application the registration time may take only few months.

Foreign Registration Certificate:

Foreign registration (i.e. the registration in any foreign country) certificate is a must to register any foreign Patent/Design in Nepal. Please send a notarized photocopy of the foreign registration certificate. We require notarized photocopy of the foreign registration certificate for each class for each Patent/Design. If the certificate has been issued in language other than English (for example Chinese, Japanese) it should be accompanied by English translation certified by Notary Public.

Power of Attorney:

Power of Attorney in favor of Pioneer Law Associates granting express authority to sign related application and/or appoint representative in the matter of registration of the said Patent/Design should be sent to us along with the other documents. There is no specified format of the Power of Attorney. Any commonly used format will do. We can provide the format commonly used in Nepal for this purpose on request. However, Notary Public should certify the Power of Attorney.
