Intellectual Property Laws

Introduction:

Nepal has a history of 65 years on Intellectual Property (except copyright law). The Patent, Design and Trademark Act 1937 was the first Act dealing with the Intellectual Property. The promulgation of the first patent, design and trademark law was instigated, among other things, by sudden spurt in industrial activities influenced by the ongoing World War II during the Rana Prime Minister Juddha Shamsher. However, the said Act has been repealed by the Patent, Design and Trademark Act 1965. This Act was amended in 1987.

Nepal is a member of WIPO, since 1996. Nepal has signed Paris Convention for the
Protection of Industrial Property (as amendment in 1979) on 16 March 2001.There are many
international instruments, in  which, Nepal should enter into. Nepal is a member of
the Word Trade Organization (WTO).
